Caspio Acceptable Use Policy

As a provider of application and database services, Caspio offers its customers (also known as subscribers), and their customers and users, the means to acquire and disseminate electronic data, files and information. Caspio respects that the Internet provides a forum for free and open dissemination of information, however, when there are competing interests at issue; Caspio reserves the right to take certain preventative or corrective actions. In order to protect these competing interests, Caspio has developed an Acceptable Use Policy (“AUP”), which supplements and explains certain terms of each customer’s respective service agreement and is intended as a guide to the customer’s rights and obligations when utilizing Caspio’s services. This AUP will be revised from time to time. A customer’s use of Caspio’s services after changes to the AUP are posted on Caspio’s web site, caspio.com, will constitute the customer’s acceptance of any new or additional terms of the AUP that result from those changes.

You agree not to use, or allow access to, Caspio services to:

1. Spam or send unsolicited commercial messages.
2. Disrupt the performance of Caspio servers or cause server-wide outages.
3. Advertise, transmit, store, post, display, or otherwise make available materials that:
   • Violate any law, regulation, or other provisions having the force of law, either intentionally or unintentionally;
   • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
   • Infringe or misappropriate the intellectual property rights of others;
   • Violate privacy, publicity, or other personal rights of others;
   • Falsify the origin of an email by forging the sender address or email header;
   • Are of adult nature, pornographic, or harmful to minors;
   • Exploit the images of children or discloses personally identifiable information belonging to children;
   • Are unlawful, harmful, vulgar, obscene, threatening, abusive, harassing, tortuous, unlawful, libelous;
   • Are viruses, worms, Trojan horses, or other destructive codes, files, or programs, or information regarding the creation of such material.

If Caspio determines that you have violated the terms of this Acceptable Use Policy, that determination, made at Caspio’s sole discretion, is grounds for immediate termination of your Caspio account without notice to you or penalty to Caspio.
